Title 36 of the Virginia Code gives the Authority the power to implement redevelopment projects. These are defined as specific areas of the City in need of extensive renewal and development. Redevelopment authorities can use the power of eminent domain as a tool in the redevelopment process for these targeted areas.

The Authority’s goals are to acquire and redevelop property in a way that eliminates blight, protects non-blighted properties within and around the area from future decay, and ensures that blight does not return. It does this by creating restrictions, ensuring upkeep, and developing the area to its highest and best use to benefit the City.


Redevelopment Project Process

Every time the City redevelops an area, an established and well-defined process is followed.

The first step after the City identifies an area of concern is the creation of a Redevelopment Plan. The Authority and City staff work together to prepare this plan, which must include proof of blight, information on where funding for the activities will come from, a property acquisition schedule, and a determination of what standards will be applied to properties in the Plan area after they are acquired and reconveyed. During this phase, input is sought from many sources, including public hearings.

After the Redevelopment Plan is submitted, Authority Commissioners decide whether to recommend that the City Council adopt the Plan. If they do recommend the Plan, the City Council reviews the Plan, decides if it meets the requirements, and votes on whether to adopt it. If it’s adopted, the Authority can then begin implementing the Plan.

Disposition Process

The disposition process helps ensure that land within the City is used for its highest and best purpose, and that adequate real estate tax revenue is generated for the City to provide funding for essential services and infrastructure.

To maintain the highest levels of professionalism and integrity, developers are carefully chosen. Requirements are in place guaranteeing that developers have the capabilities and financial resources to complete the project while meeting construction timelines. Letters of credit or cash deposits must be provided and final plans and specifications must be approved.
